This document outlines the terms and conditions governing the carriage of goods by Quab Express (hereinafter referred to as "the Company"). By utilizing the Company's services, you agree to be bound by these terms.
By using our courier services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
We provide courier services for the delivery and transportation of packages and documents. We strive to deliver all packages in a timely manner, however, we are not responsible for delays caused by factors outside of our control, such as inclement weather or unforeseen circumstances.
Pricing for our services is determined by weight, distance, and the type of service selected. All prices are subject to change without notice. You will be provided with a quote before your package is shipped.
Payment for our services is due before delivery. We accept M-Pesa, Bank Transfer and Airtel Money only.
The Company shall not be held liable for any loss, damage, destruction, misdelivery, or delay of goods, regardless of cause, including but not limited to negligence on the part of the Company, its employees, or agents. This exclusion applies to incidents such as fire, accidents, natural disasters, leakage, breakage, theft, or any other unforeseen circumstances. The Company's liability for any single consignment shall not exceed Ksh 5,000, irrespective of the value of the goods. This limitation applies even if the loss or damage is caused by the Company's negligence.
The Company does not guarantee delivery via any specific route. The Company reserves the right to choose the most efficient route for delivery. The Company will not accept goods deemed unsafe or prohibited by law, including but not limited to: flammable liquids, explosives, hazardous materials, cash, and items requiring special permits. The consignor is solely responsible for ensuring the legality and safety of their shipment. Concealing prohibited goods will result in the consignor's liability for any resulting loss, damage, or legal action.
Any claim for loss or damage must be submitted in writing to the Company within 15 days of the goods' receipt. The claim must include detailed documentation such as photos, receipts, and any other relevant evidence. Failure to meet this deadline will void any claim. A written statement by a Company manager regarding theft will be considered conclusive evidence.
The Company may refuse delivery if the consignee cannot provide sufficient identification. The Company reserves the right to subcontract carriage to third-party carriers, provided the terms are no less favorable to the consignor than those outlined herein. The Company is not obligated to notify the consignee of the goods' arrival. Consignments should be collected during normal business hours. Uncollected goods will incur storage charges after 14 days; perishable goods will be disposed of after 48 hours. Goods uncollected after 3 months will be disposed of by the Company.
The consignment note, including the receiving office register, forms a legally binding agreement. Signing the consignment note without noting any damage or discrepancies signifies acceptance of the goods' condition. Any damage or pilferage must be reported before signing the consignment note. The Company will not accept responsibility for breakage, and goods are carried entirely at the owner's risk. Insurance is strongly recommended for goods exceeding Ksh 500 in value.

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our services or your violation of these Terms of Service.
